Terms of Service

1. Who can use the Services

Our games are made for a general audience and are not directed at children under 13. To use the Services you must be at least 13, or the minimum age required where you live. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you, and is responsible for your use of the Services, including any purchases.

2. Your licence to play

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download and play our games on devices you own or control, for your own non-commercial entertainment. The terms of the app store you downloaded the game from (for example Google Play) also apply. If they conflict with these terms on how the app store works, the app store's terms win.

3. Fair play rules

You agree not to:

• cheat, or use bots, hacks, mods, exploits or other unauthorised software that changes or interferes with a game;
• copy, modify, reverse engineer or decompile our games, except where the law expressly allows it;
• disrupt, overload or try to gain unauthorised access to our games, servers or networks;
• get around or interfere with ads, purchases or other features of a game;
• harass, threaten or abuse other players, or use offensive display names;
• impersonate anyone, including YesGnome staff;
• use the Services for any commercial purpose, or in any way that breaks the law.

4. Virtual items and purchases

• Our games are free to download. Some offer optional in-game purchases of virtual items, such as coins, boosters or ad removal.
• Virtual items are a licence to use them inside the game. They have no real-world value, and can't be exchanged for money, sold or transferred, except where a game expressly allows it.
• Purchases are processed by the app store, and its payment and refund policies apply. Refund requests go through the store, for example Google Play's refund process. This doesn't affect any refund or cancellation rights you have under consumer law where you live.
• We may adjust, rebalance or change virtual items as part of running and improving a game. If a purchased item isn't delivered, or something goes wrong with a purchase, email us and we'll help.
• You're responsible for purchases made on your device or account, including by others you let use it. App stores let you require a password for purchases, or turn them off entirely.

5. Advertising and rewards

Our games show ads, including optional rewarded ads that give an in-game reward for watching. Rewards are granted as described in the game. Ads are supplied by third-party ad networks. We aren't responsible for advertisers' products, services or websites. How ad networks use information is explained in our Privacy Policy.

6. Online play

Some games include online multiplayer. You're responsible for your conduct and your display name when playing online. We may change offensive names, and remove players who break the fair play rules. Online features need an internet connection, and may not be available in every country.

7. Updates and availability

Games are updated over time. We may add, change or remove features, levels and content. You may need to install updates to keep playing. We work hard to keep the games running, but we can't promise they'll always be available or error-free. We may stop offering a game, and will give notice in the game or on our website where reasonably possible.

8. Our content

Our games, websites and everything in them belong to YesGnome or our licensors. That includes code, artwork, characters, music, sounds and trademarks. These terms don't give you any rights to them beyond the licence in section 2. If you send us ideas or feedback, we may use them freely, without any obligation to you.

9. Third-party services

The Services connect to services we don't control, such as app stores, ad networks, social networks and video sites. Their own terms and policies apply when you use them, and we aren't responsible for them.

10. Suspension and termination

You can stop using the Services at any time by uninstalling our games. We may suspend or end your access to a game or its online features if you seriously or repeatedly break these terms, if we must for legal reasons, or to protect other players. Where reasonable, we'll tell you why. Sections 4, 8 and 11 to 15 continue to apply after termination.

11. Disclaimer

To the extent the law allows, the Services are provided "as is" and "as available", without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits warranties or rights you have under consumer law that can't be excluded.

12. Limitation of liability

To the extent the law allows, YesGnome isn't liable for any indirect, incidental, special or consequential losses, or for loss of data, profits or revenue, arising from the Services. Our total liability to you for any claim is limited to the amount you paid us in the six months before the claim arose. Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

13. Governing law and disputes

These terms are governed by the laws that apply to YesGnome, without regard to conflict-of-law rules. If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of that country where the law allows. If you have a problem with the Services, please email us first. Most issues can be sorted out quickly that way.

14. Changes to these terms

We may update these terms from time to time, and will change the "Last updated" date above. If a change is significant, we'll give notice in the games or on our website before it takes effect. If you keep using the Services after a change takes effect, you accept the updated terms. If you don't agree, stop using the Services.

15. General

• If any part of these terms can't be enforced, the rest still applies.
• If we don't enforce a right straight away, we haven't given it up.
• We may transfer these terms to another company as part of a merger, acquisition or sale. You may not transfer them without our agreement.
• These terms, together with our Privacy Policy, are the whole agreement between you and us about the Services.
